The third review of the Qinghai-Tibet Plateau Ecological Protection Law (Draft) : large ice caps and glaciers are classified as ecological protection red lines

According to reports, the Second Chairman's Meeting of the 14th National People's Congress Standing Committee decided that the second session of the 14th National People's Congress Standing Committee will be held in Beijing from April 24 to 26, to review the Qinghai-Tibet Plateau Ecological Protection Law (draft), the Counterespionage Law (draft revision), and the Barrier-free Environment Construction Law (draft).
Zang Tiewei introduced that the draft Ecological Protection Law on the Qinghai-Tibet Plateau was reviewed twice at the 36th session of the Standing Committee of the 13th National People's Congress in August 2022 and the 38th session in December 2022. Based on the opinions of all parties, the third draft submitted to the Second session of the Standing Committee of the 14th National People's Congress for deliberation is proposed to make the following major amendments: First, strengthen ecological protection and restoration and ecological risk prevention and control on the Qinghai-Tibet Plateau, highlighting the special protection requirements of snow-capped mountains, glaciers, and frozen soils. Second, promote ecological protection monitoring on the Qinghai-Tibet Plateau and strengthen information sharing. Third, strengthen scientific investigation and research on the Qinghai-Tibet Plateau, highlighting long-term requirements. The fourth is to coordinate the ecological security layout and strengthen the management of industrial project access and exit. Fifth, increase the severity of punishment and further do a good job of legal convergence.
In response to the special protection requirements of snow-capped mountains, glaciers and frozen soil on the Qinghai-Tibet Plateau, the third draft proposes to make targeted provisions in the following aspects: First, it requires the establishment and improvement of a protection system for snow-capped mountains, glaciers and frozen soil on the Qinghai-Tibet Plateau, and strengthen monitoring and early warning and systematic protection of snow-capped mountains, glaciers and frozen soil. Second, provincial-level people's governments on the Qinghai-Tibet Plateau are required to classify large ice-capped glaciers and small-scale glacier groups as ecological protection red lines, enforce the closure and protection of important snow-capped mountains and glaciers, and take effective measures to strictly control man-made disturbances. Third, the provincial people's governments of the Qinghai-Tibet Plateau are required to delimit the protection scope of permafrost areas and strengthen the protection of permafrost areas and medium-deep seasonal permafrost areas. Strictly control the development of resources in permafrost areas, and strictly examine and approve urban planning and major projects such as transportation, pipelines, power transmission and transformation in permafrost areas. Fourth, it is required to carry out coordinated protection of glaciers and frozen soils of snow mountains and surrounding ecosystems, and maintain the natural ecological environment conducive to the protection of snow mountains, glaciers and frozen soils. Fifth, it is required to carry out monitoring and risk assessment of the impact of melting and permafrost degradation on regional ecosystems. Sixth, it is required to strengthen the investigation, evaluation, monitoring and early warning of natural disasters such as avalanches, ice collapses, glacial lake outburst, and permafrost melting.
In addition, it is worth noting that the third review draft specifically makes relevant provisions for scientific investigation and research on the Qinghai-Tibet Plateau, which mainly includes two aspects. First, the state shall encourage and support scientific investigations and research on the Qinghai-Tibet Plateau, strengthen research on major scientific and technological issues and the construction of major scientific and technological infrastructure in the areas of climate change, biodiversity, ecological protection and restoration, and ecosystem carbon sequestration on the Qinghai-Tibet Plateau, and promote long-term research to grasp the ecological background and changes on the Qinghai-Tibet Plateau. Second, the state is required to coordinate the layout of scientific and technological innovation platforms for ecological protection on the Qinghai-Tibet Plateau, increase the training of scientific and technological professionals, make full use of the results of scientific investigations and research on the Qinghai-Tibet Plateau, promote the application of advanced and applicable technologies, promote the transformation of scientific and technological achievements, and give full play to the supporting role of science and technology in ecological protection on the Qinghai-Tibet Plateau.
